Nope. 12/8. You can hear it.....and the tab book says so. :)

They're in 4/4.

In the SOE tab books they are written in 12/8.

Hmm maybe it was just easier to put to sheet music in 12/8, but I'm sure The Living End keep time to 4/4 when playing it.

It is easy to hear it that way. A bar in 12/8 is four lots of three quavers. You could hear it as a 4/4 bar playing triplets or three 4/4 bars. It all has to do with phrasing and what notes the accents are on.

In 12/8 the beats are in quavers and are grouped liek this:
| | | | | | | | | | | |
The accent is on the first of each group of 3.

In 4/4 the beats are in crothets and are grouped like this:
| | | |
The accent is on each crotchet beat.

Most pop-rock music accent on beats 1 and 3.... or 2 and 4 if they are playing an offbeat. But its certainly not every beat.

I repeat..

Could just be 4/4 with a swing..

You could write it as 12/8, but you could just as easily write it as 4/4.

Other examples of such songs in the same boat are Sentimental Guy by Ben Folds and Don't Change Your Plans by Ben Folds Five. Both of these songs are transcribed in 4/4 with a swing. But it's the same time signature.

(this is mel_bound) I know it, I always thought it was swing until I read the tab book, I was just being a smart arse :p

That doesn't mean musicians will play the same thing though. There are actually quite a few guidelines for choosing 12/8 over 4/4, most being to clearly express the intentions of the person who wrote the piece of music. Thats the reason 12/8 came into existence in the first place... to force classically trained musicians to swing the music.
